In Brevard County, Florida, you can trim mangroves yourself only when they sit in a riparian mangrove fringe, stand no more than 10 feet tall, and are never cut below 6 feet. Anything beyond that needs a professional mangrove trimmer, a permit, or both.

Buyers touring a waterfront home on Merritt Island, or along the Banana River in Indialantic, usually notice the same thing from the back porch. There is a green wall between the yard and the water. That wall is mangroves, and in Florida they are protected by state law. You do not get to treat them like hedges.

This catches relocation buyers off guard more than almost anything else about waterfront on the Space Coast. Nobody expects to need a state statute before trimming a shrub in their own back yard. But cutting the wrong mangrove the wrong way in Brevard County can turn into an enforcement matter, so it is worth ten minutes of reading before you write an offer.

What is the Florida Mangrove Act, and why does it apply on the Space Coast?

Florida's Mangrove Trimming and Preservation Act dates to 1996 and lives at sections 403.9321 through 403.9334 of the Florida Statutes. The Florida Department of Environmental Protection administers it, and Brevard County sits inside DEP's Central District.

The act covers three species: red mangrove, black mangrove, and white mangrove. One detail surprises almost everyone. According to DEP's mangrove guidance, the act does not distinguish between living and dead mangroves. The same trimming rules apply to both.

When can a Brevard County homeowner trim mangroves without a permit?

There is a homeowner exemption, and it is narrower than most people assume. Every one of these has to be true at the same time:

• The mangroves are in a riparian mangrove fringe
• They are no more than 10 feet tall, measured from the substrate
• You do not trim any mangrove below 6 feet
• You do not defoliate any mangrove

Miss one of those and the exemption does not apply. Here is how the common situations sort out on a Space Coast waterfront lot:

What counts as a riparian mangrove fringe?

The term comes from section 403.9325(7) of the statute. A riparian mangrove fringe is where the mangroves along your shoreline do not extend more than 50 feet waterward. DEP measures that from the most landward mangrove trunk to the most waterward mangrove trunk, in a line perpendicular to the shoreline.

Height is measured from the substrate, which is the point where the trunk meets the ground. That holds even when the base of the tree is underwater. On a lot in Cocoa Beach or Satellite Beach where the shoreline is soft, that measurement is not always obvious from the seawall, so a survey pole matters.

What about mangroves growing over your dock or into your seawall?

Florida law accounts for this. Section 403.9328(5) provides an alteration exemption when trimming is part of certain exempt or permitted environmental resource activities. In practice that means a Brevard County homeowner is generally exempt to trim mangroves within the footprint of a docking structure, plus branches hanging over the dock that block access, and to address mangroves growing into a seawall as part of maintaining or repairing that seawall.

DEP asks that you contact the district office with a description and photos before you start any of that work. That call is free. An enforcement file is not.

Can you remove mangroves from a Space Coast lot?

Generally, no, not under an exemption. The trimming exemptions and general permits in the Mangrove Act do not cover removal. Taking mangroves out means applying for an individual permit at the district office, and mitigation may be required.

That includes the request DEP hears constantly from waterfront owners in Melbourne and Merritt Island: clearing a gap so you can walk a kayak to the water. It sounds minor. Under the statute it is still removal.

When is the best time of year to trim in Brevard County?

DEP points to October through March. That window is when mangroves grow the least, so trimming affects them the least and does not cut off new growth. The department also warns against trimming during or around a freeze event, which is more of a north Florida concern than a Space Coast one, but worth knowing if a cold snap is in the forecast.

What waterfront buyers in Brevard County should check before closing

If the water view is the reason you are paying a premium for the property, treat the mangroves as part of your due diligence, not an afterthought:

• Walk the shoreline and note how tall the mangroves are and how far waterward they run
• Ask the seller directly whether any trimming has been done, and whether any permit was pulled
• Budget for a Professional Mangrove Trimmer if anything is over 10 feet
• Confirm with DEP's Central District office if anything about the shoreline looks unresolved
