Before you buy a short-term rental property on Florida's Space Coast, there is one thing that will make or break your investment before you even get the keys: knowing whether short-term rentals are actually legal at that specific address. One wrong purchase and your rental income disappears before you earn a dollar. Here's the city-by-city breakdown from Rachel and Nichole, who navigate these rules every day for investors and second-home buyers.

What Is a "Short-Term Rental" in Brevard County?

A short-term rental (STR) is defined as any rental under 30 days. The regulatory landscape here is complex because it involves a 2011 Florida state law that grandfathered cities into their existing restrictions at the time — meaning cities that had no minimum stay requirement before 2011 can never add one. This is why Cocoa Beach and a few other areas remain investor-friendly while others have locked in restrictions permanently.

City-by-City STR Rules (2026)

Cocoa Beach — Nightly Allowed

Cocoa Beach had no minimum stay law before 2011, so it was grandfathered in. Nightly rentals are allowed and can never be changed by the city. This makes Cocoa Beach one of the most investor-friendly STR markets on the Space Coast.

Cape Canaveral — 7-Day Minimum

Cape Canaveral has a 7-day minimum stay requirement. Still very investor-friendly — weekly rentals work well in this market — but not the nightly-rate premium of Cocoa Beach.

Indian Harbour Beach — Nightly Allowed

Indian Harbour Beach also never had a minimum stay rule and is grandfathered in for nightly rentals.

Merritt Island — 90-Day Minimum (Most Areas)

Critical warning: If you Google "are short-term rentals allowed in Merritt Island?" the answer often shows as "yes." This is misleading. Merritt Island is county jurisdiction (unincorporated Brevard) and falls under the county's 90-day minimum for single-family zoning. The vast majority of Merritt Island does NOT allow true short-term rentals. Multifamily zoning has different rules, but single-family is restricted.

Satellite Beach — Mixed (City vs. County Jurisdiction)

Satellite Beach proper (city jurisdiction): 6-month minimum. County jurisdiction areas east of A1A: different rules apply with more flexibility. This is extremely property-specific — the rules can change across the street.

Indialantic — Complicated

Generally 6 months. However, some properties with an Indialantic address actually fall under Melbourne city jurisdiction (which can be nightly) or county jurisdiction (90-day). You need to verify the specific zoning and taxing district for each property.

Melbourne Beach Proper — Nightly Allowed

Melbourne Beach proper allows nightly rentals. County jurisdiction areas in Melbourne Beach are subject to the 90-day rule. Again, property-specific verification is essential.

HOA Warning: Always Check Before Buying

Even if the city/county allows short-term rentals, an HOA can override that and restrict rentals. HOAs can change their rules at any time — meaning a property that allows STRs today could prohibit them next year. Rachel's rule: avoid single-family HOA properties for STR investment unless you're in a condo that has explicitly established rental-friendly rules.

Real example: a house near Rachel was sold as an "active Airbnb." The neighborhood actually prohibits STRs. It ran fine for a while until one bad party, a neighbor complaint, and a cease-and-desist shut it down. The investor had furnished and renovated specifically for STR — and lost all the rental income potential they'd planned for.

The Best STR Investment Areas on the Space Coast

Rachel and Nichole direct most STR investors toward Cape Canaveral and Cocoa Beach for their reliable STR-friendly rules and high demand. Specifically:

  • Canal homes near downtown Cocoa Beach: walkable to restaurants/shops, golf cart or bike access, high demand
  • Non-HOA single-family homes in Cape Canaveral and Cocoa Beach: most predictable STR environment
  • Townhomes in these areas (some have no HOA): more budget-friendly entry point
  • Pool homes: strongly preferred if the property is more than a few blocks from the beach

Mainland opportunities: Eau Gallie Arts District (bridge to beach, downtown feel) and Rockledge (near the USSSA baseball/softball complex where families visit every weekend) are underutilized STR markets that may offer better cap rates due to lower property prices and insurance costs.

Who Are Short-Term Rentals Good For?

Three types of buyers consistently work well with STRs here:

  1. Future retirees — secure a property now, rent it out to cover costs, and retire into it later
  2. Second-home buyers — use it during winter (January–May, the prime rental season), rent the rest of the year
  3. Pure investors — harder to cash-flow big at current interest rates, but mortgage interest is deductible; focus on breaking even while building equity

Breaking Even vs. Cash Flow in 2026

At today's interest rates, the large ROI numbers of 2021 are unrealistic for most financed purchases. Rachel's honest advice: target properties where you can at least break even — covering mortgage, insurance, HOA, and management fees. The equity play and the fact that you're not paying rent for your own Florida vacations are real financial wins even if you're not netting thousands per month.

Prime rental season on the Space Coast: January through May (snowbirds, spring breakers, and early summer). Condos tend to perform better for snowbirds (no stairs, easier access). Pool homes attract summer families. Mid-term rentals (2–3 months) to aerospace contractors building new homes or working on project-based assignments are a growing, underserved market.

Condo Market Update (2026)

The wave of high special assessments following Surfside-era regulations has largely run its course. Most Brevard County condos have completed their milestone inspections, engineering reports, and required repairs. Condo fees and assessment concerns are stabilizing — which improves the investment case for well-maintained beachside condos that were previously hard to underwrite due to fee uncertainty.
