Does Florida protect your home from creditors?
Yes. Florida's constitutional homestead protection shields your primary residence from forced sale by most creditors, with no cap on value, up to a half acre inside a municipality or 160 acres outside one.
When people relocating to Brevard County talk about the "homestead exemption," they almost always mean the property tax break. That is one of two completely separate protections Florida attaches to a primary residence, and it is the smaller one. The other is a creditor protection written into the Florida Constitution itself, and it is one of the strongest in the country.
This matters most to a specific kind of Space Coast buyer: business owners, physicians, contractors, anyone carrying professional liability, and anyone arriving from a state where a judgment could reach the equity in their house. If that describes you, the difference between the two homestead concepts is worth understanding before you decide how much of your net worth to put into a house in Melbourne, Suntree, or Merritt Island.
What does Florida's homestead creditor protection actually cover?
Article X, Section 4 of the Florida Constitution exempts a homestead from forced sale under process of any court, and provides that no judgment, decree, or execution shall be a lien on it. The acreage limits are geographic:

Notice what is missing from that table: a dollar figure. Florida does not cap the protected value. A half acre lot in Indialantic with a fully paid off house on it is protected on the same constitutional footing as a modest place in Rockledge. That is unusual. Most states cap homestead protection at a specific amount, often a small one.
The acreage distinction matters in Brevard County more than in many places, because the county has both incorporated cities and large unincorporated areas. A home inside the City of Melbourne is subject to the half acre limit. A homesite in unincorporated Brevard County is measured against the 160 acre standard. Where the municipal boundary falls is a factual question, and it is worth confirming with the county rather than assuming based on a mailing address.
What debts can still reach your Florida homestead?
The protection is broad but it is not absolute. The Constitution carves out three categories, and they cover the debts most people actually carry against a house:
- Taxes and assessments on the property itself.
- Obligations contracted for the purchase, improvement, or repair of the property. Your mortgage lives here. So does a home equity loan and a renovation loan.
- Obligations contracted for house, field, or other labor performed on the realty. This is where construction and mechanic's liens sit.
So the protection does not stop your lender from foreclosing, and it does not stop the county from collecting property taxes. What it stops is an unrelated creditor, a business judgment or a personal injury judgment for example, from forcing a sale of your Space Coast home to satisfy that debt.
There is also an anti-abuse rule. The exemption does not apply to homestead property that is acquired, or whose equity value is increased, through prepayment of mortgage debt with intent to defraud creditors. You cannot see a judgment coming and pour cash into your house to hide it.
Do you have to file anything to get the protection?
The constitutional protection attaches to a qualifying homestead. It is not an application based benefit the way the tax exemption is. That said, Florida Statute 222.01 lets a person who wants to claim the benefit make a written statement describing the property and declaring it to be the homestead, signed and recorded in the circuit court of the county where the property sits. Recording that declaration can head off arguments later.
Because the caselaw here is deep and fact specific, and because losing the protection is expensive, this is a topic to take to a Florida real estate or asset protection attorney rather than to a message board. How is this different from the homestead tax exemption?
Different source, different administrator, different process. The creditor protection comes from the Florida Constitution and attaches by operation of law. The tax exemption is administered by the Brevard County Property Appraiser and you have to apply for it.
For the tax exemption, you must qualify on or before January 1 and file on or before March 1 of the year the benefit applies. BCPAO asks for a recorded deed, a Florida driver license or ID card, Florida auto registration, a Brevard County voter registration card, and a Social Security card. If you own property in another state, you will also need a letter from that state's taxing authority confirming you are not receiving a residency based benefit there.
People arriving on the Space Coast from New Jersey, New York, and Illinois routinely underestimate the second half of that list. If you are keeping a house up north, plan for the documentation before your first Florida January 1 rolls around.
What happens to a Florida homestead when the owner dies?
Florida also restricts how homestead property can be left in a will. Florida Statute 732.401 governs the descent of homestead when there is a surviving spouse or minor child, and it can override what the will says. Married couples buying on the Space Coast, and anyone with children from a prior marriage, should get estate planning advice from a Florida attorney rather than assuming a will drafted in another state does what they think it does.

Does Florida homestead protection apply to a vacation home in Cocoa Beach?
No. The protection is tied to the owner's primary residence. A second home, an investment property, or a short term rental in Cocoa Beach or Satellite Beach does not qualify, and neither does property held in a way that severs the individual ownership the Constitution contemplates. Ownership structure matters enormously here, which is another reason to get advice before you title anything.
If I move to Brevard County from another state, when does the protection start?
It attaches when the property becomes your homestead, which turns on residency and intent rather than on a filing date. That is separate from the March 1 deadline for the property tax exemption, which is a hard calendar deadline with the Property Appraiser.
Is there a federal limit if I file bankruptcy?
Federal bankruptcy law imposes its own timing rules on how much homestead value a recent arrival to a state can protect. This is exactly the kind of question to bring to a bankruptcy attorney licensed in Florida before making decisions about where to put your money.
